Um… OK… No? Maybe?
Indie band OK Go tried to stop Post Foods from receiving a trademark when they applied to register “OK Go!” for its recently launched brand of just-add-water, to-go cereal, and they also sent a cease and desist. Post Foods then proceeded to sue the band — seeking a declaration it can use the OK GO! trademark plus attorneys’ fees — under the premise that they would be “unfairly forced to continue investing in its new OK Go! brand while under the constant threat of unfounded future litigation by defendants.” One important thing to clarify is that Post Foods is not suing the band for them having a similar name (which did they first) and demanding they not use it but to stop the band from pursuing legal action and allowing the cereal to use the name in a completely different
